New Alabama Laws Hopes to Curb Doctor Shopping and Prescription Drug Misuse

Alabama recently passed three bills that will aide in the fight against prescription drug abuse and diversion.

HB 150 - Alabama Prescription Drug Monitoring Program - Physicians can now allow staff members to access the database on their behalf. The Medicaid Agency is also permitted to use the database to check the medication history of patients enrolled in Medicaid.

HB 151 - The Pain Management Bill - Requires the registration of pain clinics and requires medical director licensed in state. Permits the Medical Board to issue subpoenas during the investigation of these clinics.

HB 152 - The Doctor Shopping Bill - Makes it a Class A misdemeanor to lie to doctors about similar prescriptions to get more drugs. Penalties upon conviction include up to a year imprisonment and typical fines and financial penalties. Enhancement available after four convictions to Class C felony, which could lead to a prison term of up to 10 years.
